II. Product Information and Pricing
1. All information about the products, including their prices and main characteristics, is available in the online store catalog. Prices are listed including VAT and all related fees, except for potential shipping and packaging costs.
2. The product offerings in the online store catalog are non-binding, and the seller is not obliged to conclude a purchase contract.
3. The seller reserves the right to change prices without prior notice.
III. Ordering and Conclusion of the Purchase Contract
1. The costs incurred by the buyer when using remote communication means in connection with the conclusion of a purchase contract (internet connection costs, telephone call costs) are borne by the buyer. These costs do not differ from the standard rate.
2. The buyer orders the goods in the following ways:
- Through their customer account, if they have previously registered in the online store,
- By filling in the order form without registration.
3. The buyer must provide accurate information when placing an order. If incorrect information is provided, the seller is not responsible for incorrect delivery or any resulting costs.
IV. Payment Terms and Delivery of Goods
1. The buyer may pay for the goods in the following ways:
- Bank transfer (cashless payment).
- Online payment by credit/debit card or digital wallet.
2. The shipping cost is determined based on the current rates listed in the online store.
V. Withdrawal from the Contract
1. The buyer acknowledges that under Section 1837 of the Civil Code, it is not possible to withdraw from a purchase contract for the supply of goods that are perishable or that have been irreversibly mixed with other goods after delivery. Since wine is a food product, it cannot be returned within the standard 14-day withdrawal period.
2. Withdrawal from the contract is only possible if the product has not been opened and remains in its original, undamaged packaging, with proof that it has been stored under conditions consistent with the seller’s recommendations.
3: In the event of a recognized complaint or withdrawal from the contract in accordance with these conditions, the purchase price will be refunded without undue delay, no later than 14 days from the receipt of the returned goods by the seller.
VI. Complaints (Claims for Defective Goods)
1. The buyer is required to check the condition of the packaging and the integrity of the bottles upon receipt of the shipment. If any damage is found, it must be reported to the carrier, and a damage report must be drawn up. Complaints about physical damage caused during transport that are not identified upon receipt may not be recognized.
2.If the buyer identifies a product defect, such as oxidation, cork taint, or other sensory defects, they may submit a complaint to the seller. The complaint must be supported by a photograph and a description of the defect, or, if necessary, a sample of the defective product.
3. The seller will assess each complaint individually and may offer a replacement product or another suitable solution.
4. Complaints do not apply to cases where the wine was stored incorrectly (e.g., exposure to high temperatures, direct sunlight, or improper handling).
These Terms and Conditions take effect on February 19, 2025.
